Sponsor's Licence application rejected

Post by Genuinealb » Wed Oct 06, 2010 1:11 pm

An update,

As I have posted before, I am on 36 months Work Permit Visa, which expires on the 1st of November. The work permit expires at the same day as visa does because it starts when visa started.

I am staying with the same employer, same position, so I qualify under Transitional Arrangements but emplyer is not on the sponsors register. (I do not qualify for Tier1).

The company applied for a licence on the first week of september but the application was rejected 1 week later because the documents were uncertified coppies.

They applied again by mid september and sent certified coppies of documents by a member of public. Also they sent a letter explaining the sittuation and lack of time. On 23 we got a letter to confirm the receive of documents and the payment.

On 29 of September the company has been rejected again because the documents should be only certified by a solicitor and also they need a letter from the inssurance company becase the Employers Liability Inssurance Certificate is not good enough.

I am so stressed out. Today is 6th of September and we are still waiting for that letter from the insurance company which might arrive today or tomorrow.

Now the time has really run out i guess. However I will wait until last day and see what happens.

In the meantime is there any sugesstion you might give me or any ideas on how I might extend my application or switch to another category?

Many thanks.

Its a shame....why ur employer didn't apply year earlier???
there is noting u can do apart from waiting,
or ur company can send ur COS application along with current application with a letter explaining the situation, in this case ur COS application may be considered at same time. But make sure u send everything according to requirement including payment certified documents etc.

There is other thing which i can think of is;

In extreme case..when u see nothing is happening u can send ur Tier 2 application without COS. I know ur application will be refused but at least u will not overstay and then either u can send change of circumstances form afterwords or go into appeal and then produce missing documents.
I don't know if it is a good idea but if any senior member can comment on it, i will appreciate.

Thanks Dilber, (where are you from by the way?)

This is exactly what I am going to do. Also I will write a latter in big bold font saying:
Guys, my company f....d up their bit with the documents so the time run out. Hopefully they got it right this time so can you please hold the fire on my application until they have a response.

God help us all.
