EXPERT'S ADVICE REQUIRED

Dear all,

I am looking forward for your advice in filing of my dependants visas. Kindly find details hereunder for your understanding.

My dependants landed in the UK on January 2008 as HSMP dependants and stayed with the main applicant, until main applicant’s secondment in Saudi Arabia on behalf of UK based office in December 2008. Me and my dependants logically made the next move and applied for the appropriate working visa to enable myself (main applicant) to work in Saudi Arabia.

We (me and my dependants) were in our Home Country for approximately 2 months from 10th January 2009 to March 2009 for Saudi Arabian visa process,duringthe time period my wife gave birth to my son in February 2009. My son had not been issued any UK visa previously.

Once the work visa was issued I moved to Jeddah and commenced work on behalf of my UK based office. My family joined me a month later in April 2009 and currently they are living with me in Saudi Arabia.

In November 2009 I filed extension applications for my self and my dependents through OISC registered Solicitor, at PEO Office Croydon (after failing to receive any advice on my complicated case)At the time of application I was in the UK, whereas my dependants were in Saudi Arabia. PEO office extended my HSMP visa via Tier-1 without having any objection, but returned my dependants application and passports without processing, to my High Commision in the London for safe keeping of the passport until passport holders contacted High Commission. PEO Office, Croyodon returned these applications and passports with a note that “the enclosed passports were submitted to this Directorate but the applicants were not in the United Kingdom when the application for further stay in the United Kingdom was made we are unable to process the application for the named aboveâ€

Apply for Entry Clearance as dependent(s) of Tier 1 migrant from Saudi Arabia / home country. See also Tier 1 (General) Dependent application queries.

IMHO, explain the circumstances of the previous application(s) submitted in Nov. 2009 and the outcome. That should convince the ECO that you are not trying to hide any facts. Also, make sure you understand whether your dependents' applications were "not processed" or "refused" - because if they were indeed refused then you'll need to mention that in the application form (which asks for such information).

Thank s Shushd,

The only sentence in the letter I have received with my dependants passports is as follows;

“the enclosed passports were submitted to this Directorate but the applicants were not in the United Kingdom when the application for further stay in the United Kingdom was made we are unable to process the application for the named aboveâ€

I have checked in the Entry Clearance link you have forwarded but unable to findout application form there? I will appreciate if you could help in this regard.

Yes my work permit "IQAMA" is valid for another year. Kindly explain please that, Who you are considering the sponsor, My UK based office or the sponsor of my work permit in Saudi Arabia, secondly what should be written on this letter from sponsor???? Kindly note that I am not applying for my own visa, but this application is for dependent visa only.

In the second paragraph, you have written that "Your case is simple but it depends " how you make your company letter , how you represent your account statements " I will appreciate if you could elaborate further that what is meant by the above phrase. Am I suppose to make a company letter also??? Which company it should be, my UK office or the Saudi company sponsoring my visa?? What should be the subject of this letter and what information / confirmation this letter should be bearing??

I have enough funds (more than 20 times the required funds to support myself and each of my dependents) available in British as well Saudi Banks to show as my maintenance funds. What do you mean by "how you represent your account statement" I will appreciate if elaborate further.

Once the Tier-1 dependent visa would be stamped, Is there any time line associated for entry into the UK??? or it is open to enter anytime during the visa validity????
