I am a non non eea citizen married to a spanish woman since december 2001, i applied for residence permit in january 2002 but i only received it in july 2003, 1.5 years later.
I need to clarify that i was an asylym seeker before i got married and that i arrived in the uk in january 2000.
Now i am trying to aply for permanet residence and i fulfill all the requirements but i am not sure if the home office will consider the time spend by them to process my application "1.5 years" towards the four year qualifying period requested.
So does the date from which i got married or the date i was granted the 5 year residence permit counts as the starting date for the four year period qualifying period for permanent residence as a spouse on an eea citizen living in uk.
I also need to stress that during the 1.5 year process i was never contacted for anything and also when i received the residence permit the home office admited to have lost my file for that peiod of time.
