In USA on B1/B2, have job offer wd like to stay

In USA on B1/B2, have job offer wd like to stay

Hi, I'm here on a B1/B2 which is valid for another few months. In the meantime I've received a good job offer in my field.

Myself, husband and child would like to stay- anyone any ideas which forms to use to stay, apply for an employment authorisation or business green card? - is it possible at all or do you have to leave ? Thanks,Mary

Not enough info on the job offer. I presume its a bonafide H1B class related offer - the quota AFAIK is used up for this fiscal year so none will be issued until October 1 unless its in an exempt category. If no H1B then you may not apply to change status in the US. If you don't apply for an extension or change of status within the validity of your I-94 then you fall out of status and are in breach of the immigration laws effectively ending your chances of ever obtaining a US visa.

The DHS may accept an extension application of your B1/B2 but this is likely to be refused where your reason is merley to await the H1B quota to resume. DHS will understandably consider that a family will require more resources to continue 'visiting' the US relative to an individual so expect to show evidence of substantial funds.

IMHO its best to go back home within the validity of your B1/B2 based I-94 and apply for H1B visa after you get your petition/I-797 approval notice.
