Tier 1 visa initial application

Tier 1 visa initial application

I am holding initial UK tier 1 visa applied within UK which is valid until Aug 2010. Currently I am in India from April 2009, I want to know - Is it possible to go to UK on current visa and then apply initial UK tier 1 visa again showing previous earning in India with uplift factor.

I mentioned validity of visa incorrectly. My visa is valid until Aug 2011.

Please advice on

Is it possible to go to UK on current visa and then apply initial UK tier 1 visa again showing previous earning in India with uplift factor.

Thanks susdmehta.

Just wanted to know, Why it is not possible to apply intial Tier 1 visa when in UK on existing Tier 1 visa. I can understand this for extension application where I definitely can not apply uplift factor on my indian salary as I was away from UK during that period.

If it is still not possible within UK then can initial application be done in India in this scenerio.

Your help will be highly appreciated

Initial application is meant for people who do not possess a Tier 1 leave to enter/remain, not for people who already possess one.

If what you wish were to be allowed, then what would be the point of "extension"? Won't everyone then keep on applying for "initial" Tier 1 leave?

Let your current leave expire (outside UK), and then you may apply for "initial" Tier 1 application from outside the UK. Or enter UK under another immigration category that allows you to switch to Tier 1 (General) and then make an "initial" Tier 1 (General) application from within the UK.

Okay, now I understood that I can not apply within UK. You have mentioned that I should have to wait until current leave to remain expires before applying initial application even in India.

I really want to apply before March 2011 (which is before my current leave to remain Aug 2011) to get 10 points of Age for 32-34 yrs now and later in extension.

Also I want to mention that I came to UK in Jan 2006 on WP and stayed there till March 2009. I switched to Tier 1 in Aug 2008 so stayed there around 6 months on Tier 1 from Aug 2008 to Mar 2009

I also enquired about this from VFS here in India as follows

"I have UK Tier 1 General Visa valid until August 2011. This visa was an initial applicationfrom UK. Currently I am in India from April 2009, now I want to travel to UK and wants to apply for Tier 1 visa again as an initial applicant from VFS India.

1. Is it possible to apply UK Tier 1 General visa as an initial applicant while holding one. Also if is possible then is there any time limit on initial application considering my existing visa valid until Aug 2011."

VFS Reply

"Thank you for contacting VFS UK Visa Helpdesk.

With regards to your query, we would like to inform you that you can apply for the fresh Tier 1 visa though you are holding the valid Tier 1 visa. There is no such limit to apply.

Please do let us know if we can be of any further assistance"

Now reading your reply of waiting till current leave to remain I am little confused.

Please suggest.
