Rejected UK Tourist Visa, Travel to France / Schengen Region

Post by dbmworldtraveller » Fri Oct 08, 2010 4:22 pm

Hello Everyone,

My girlfriend and I are both US Citizens from birth and hold US Passports. My company asked me to come to the UK for a 6 month period to work, and I had planned to have my girlfriend come visit for a three month period as a tourist, and through bad advice, we ended up having her apply for a tourist visa to the United Kingdom. Her first tourist visa application was rejected due to lack of paperwork, which led us to apply again for a second application, but was rejected because of complications with my work visa which have been sorted out now.

Once my visa was completed, and I was in the United Kingdom working, we were given additional bad advice, and she attempted to visit for a 3 week period. She applied for a tourist visa at the border and was rejected, and deported. The immigration officer advised us to get a lawyer and review the visa application.

A co-worker was able to help review documents needed, we reapplied for a tourist visa and it was rejected stating they did not believe she had intent to leave once in the United Kingdom.

At this point, she has three rejected tourist visa applications, and 1 rejected application at the UK border. In light of our set backs, we have made plans to take three weeks to travel Europe (France, Belgium, Germany, Italy). I know that all of these countries are apart of the Schengen Region, and that a US Passport would be allowed in as a tourist for three months.

Given all of that back story, would she be allowed to enter France or the Netherlands even though the United Kingdom denied her entrance? We have no intention of going to the United Kingdom, and want to just visit countries in the Schengen Region. We are not 100% confident that other EU countries will stop her at the border as well.

I think she will have to apply for a visa to be safe. Since 2007 UK shares information about visa refusals and bans with Schengen-zone countries.

Hi, i'm hearing you and feel for you both, when hazy immigration rules seperate you from your partner, it's just not right.
Anyway, I was falsely accused of overstaying in the U.K. when in fact I had not but did not have my flight ticket stubs of previous flights to prove it. I am Australian and when I tried to re-enter earlier this year I was denied entry because of this, even though I had the proof that the original accusation was false. Frustrating!!!!
So my girlfriend is going to work in France for four months in December and I plan on going for the three month visitors visa. As far as I can tell, no immigration lawyers or officials can tell me if I will get in, the French embassy told me to just take the chance!!!! So French, I love it!!! There is no process for applying for a visitor visa, as we automatically get one when we arrive in the country.
Anyway, I think you just have to have an air-tight itinery and give all the right answers as she will get questioned.
Good luck and please anyone who has been in this situation post your experience, I'll let you all know how i get on!!!

my friend has never been refused.

the point i was making was that no visa was involved in the first place.

the case in question is very sad.
