hi there,
my one of the friend is apply by next Jan, he is working as a Consultant he want to show...
1) Bank statement (
2) Employer Letter that confirm gross and net pay
3) Appoinment Letter.
pls confirm that those documents are OK?

-> Self-employed applicants only - letter from the applicant’s accountant (confirming that the applicant received the exact amount he/she is claiming, or the net profit to which he/she is entitled).
->Business bank statements showing the payments made to the applicant. (this could be normal savings account as well)
->Invoice explanations or payment summaries from the applicant’s accountant.
->Where an applicant is submitting a combination of bank statements and a letter/invoice summary from their accountant, they must also provide copies of any invoices generating during the period for which earnings are being claimed.

Thanks for replying, but he is not applying on self employed , he working as a marketing consultant, and his company giving his salary when he passed good orders to his company( not reguler basic salary), i mean salary based on commition.

Please check if he/she is an "employee" of the company in question. he way you have explained what he does and how he gets paid, I doubt this "employee status".

now very clerly mention:
where he working as a freelance Business Research & Marketing Consultant (on contract basis).He received remuneration on completion of this contract.
Documents:
1. Appointment Letter of xxx Pvt. Ltd. dated 12th September 2009 state contract details and gross remuneration on completion of contract period.
2. Original XXXX Bank statement for the total period of claimed clearly highlighting payment claimed.
3. Certified Chartered Accountant’s (C.A) Letter on the headed paper with gross income from xxx Pvt. Ltd. for the financial year . The seal of the C.A contains the membership no. of his ICAI registration (Institute of Chartered Accountant of India), a registered body of C.A’s in India.
Now any documents he need to include.

does the company pay NI ?
first you have to establish he is an employee ...the info you give does not do it. points more towards self-employed
does he get payslips

He is not an employee but a self-employed person. The answer to your queries has already been provided by pkumar.

Before i mentioned that my frnd will claime 30 points for his current earnings base on his income from xxx Pvt. His Consultant Segesstion:
Those are good forms of evidence but it is not possible to say if it is sufficient without seeing both the wording and the format of the evidence. It is often the case that the wording of the accountant's letter needs to be changed and sometimes the case that a further letter from your client would be beneficial
Q-2) His claim period is 1st july-2010 to 15th march-2011.
we can claim under 12 months earnigs period?
His Consultant Segesstion:
You can pick any consecutive 12 months in the last 15 before application. If you want to claim fewer than 12 months you can.
Are they saying correct or need to apoint another Consultant?

if the accounts statement is genuine I dont think the wording is going to be a problem
the numbers matter more.
is the company registered. is your friend the only shareholder ? - i.e is there documentation for that
how is the funds from the company's business account transferred to the personal bank account ? is the tax return for the company filed ?
basically prepare the documents based on how any lay person would need to understand the set up...

Hi there,
Ya company is registerd with Ministry of Corporate Affiers(Indian Goverment Reg. Body), and so many staff woriking in this firm and my frnd's paye is likly to transferd with Chaque tranjacation and tax will be filed end of finacial yer...but frnd will apply b4 end of finacial yer so he will not abel to put tax documents..and some more quries:
the think is that my frnd's pay of July, aug, sep,oct's money is cming in end of this month alltogether (Working as a freelance tempory contract basis) after octomber it will cming evry end of month.......his employer is redy to giving breakdown letter with sign and stamp with registerd CA....... after that can we claim earnig period of July-10 to march-2011.

I am totally confused - you say xxx ltd. as the company - who is the owner ?
is there sales tax on invoices ?

Idea, the OP seems to be unable to differentiate between self-employment and employment. The individual in question is self-employed and works for a client (the xxx ltd. company) as a contractor. But the OP keeps referring to the client as the "employer".

I have been employed and self-employed both in india and in the uk and i am not able to understand the arrangement of your friend.
Please bear in mind that the caseworkers are normal people like you and me equipped with a set of guidelines and std.s to work with .
They do not have the chance to ask questions and clarify doubts with the applicant and have to take the decision on the doc.s provided
with the facility of posting back and forth you have not been able to convince the forum members ...decide on what chance your friend has..
