Applying for PSW when student visa is about to expire

Post by camille » Sat Oct 09, 2010 2:47 am

If you apply while your student visa is valid, but it expires while your application is being processed and you are in the UK, will you be considered an illegal immigrant during that period? If so, how do you leave the country while your passport has been submitted, etc?

Thanks in advance.

Please go ahead and submit your application. If you are making an application by post then the HO will consider the posted date of the application so make sure you post it before your current visa runs out. You can still stay in the UK legally while your application is considered. One important thing, please make the payment to the HO by postal order as this 100% safe.

Thanks for the advice.

What if the application is rejected, won't you be considered to have overstayed?

Also, how long does it usually take if you apply within the UK?

I can't really comment how long it will take, as I personally have recevied application as soon as 15 days and as late as 16 weeks. So it really depends on the case worker.

No.

Section 3C applies.

If your application is refused you might get "right of appeal" against the decision or a date by which you have to leave the country. I hope the best for you.

Thanks. I've been getting different answers about this one. Most students I know said that you are considered an illegal immigrant if your visa expires while your application is being processed. :o

I also wanted to ask if it is harder to get this visa once you are back in your home country?

what happens if the application is rejected on appeal and the student visa has run out by then. Can I reapply or do I have to return to my home country and apply from there?
