I've been working with the same company for over 5 years now while I was on my working holiday visa, student and now currently on my post study work visa. However, I was looking to switch from Tier 1 to Tier 2 (General). My Tier 1 PSW expires on the 30 March 2011.

I made the first application for the switch, and at the time I was getting paid 21K and we were unaware of the salary indicated in the codes of practice. Therefore the company applied for a license with the job title 'Financial 3534' which corresponded to a salary of 26K and my application was refused as a result.

However my company has kindly agreed for a pay rise to satisfy the 26k minimum salary requested by this job title, so I can apply again. However, they gave me an increase of 24000 in august and they will give me another increase on the 1 February 2011 of 26K which I will need to apply.

My question is should the 26k I need to qualify be shown on my pay slip over three must at least or 1month pay slip which will be end of February 2011 be ok or as long as I indicate I’m getting 26k on the day apply for COS cause I’m planning to apply on end of February 2011. I know I have to give 6 months pay slip when I apply, but the last month pay slip will be the only one showing 26k. will that be ok for me to apply or not.

Also I want to do the same day service when I apply cause I need to travel in the begin of March.

there shouldn't be a problem with u r earnings, if u meet the minimum wage requirement at the time of the application u should be okay. but still u have to show u r prevoius 6 months pay slips for switching from post study to tier 2 general. tell u r employer to request for the allocation as early as possible if they havn't got one for you. in the last two panel meeting they didnt considered psw cases, they were rejecting all allocation request for psw workers. all the best mate ..

Thanks for your response. So there won’t be a problem if my salary requirement are ok at the time of the application, really happy to know that.

Ok, I will have all previous 6 months pay slips when I apply, so from end sept 10 – end Februay 2011. Because I want to apply on the 1 March 2011 in person.

Can you please just clarify the last bit not sure what you meant ….“in the last two panel meeting they didnt considered psw cases, they were rejecting all allocation request for psw workersâ€

your pay slips are not proof of your salary but evidence that u worked for ur employer for 6 months, you will be awarded points for earning on the basis of what is stated in ur certificate of sponsorship no further proof required.
i had my 6 pay slips showing slightly lower than what i was earning at the time of application but i successfully switched from psw to tier 2.

Thanks really your comments are really helpful. I'll just have wait know till end of February to apply, just hope the HO don't change any rules by then. Thanks again
