advise me please about 320(11) with EEA family permit

hello all i am have problem with 320(11) also



i am a thai national , my husband he holding uk passport and will have irish passport sooner...
i have asked for sattlement visa to uk on 2009 also, and they not give me visa under 320(11)
i had used fake passport to uk when i first entry to uk

and some people said i can apply to EEA family permit to uk
they said this rules of 320(11) will not work with EEA family permit to uk
my question is
1.when i marry with my husband under his uk passport then i can apply for EEA visa under his irish passport or not?
2.Do get chance to have EEA visa to uk?

Probably depends on the outcome of the McCarthy case at ECJ, unless you qualify under Surinder Singh.

320(11) is not applicable under the EEA regulations.
