COA or Notice to Marriage Registrar

Post by firozibrahim » Fri Sep 03, 2010 1:04 pm

Hi all

I am on Visit visa, I am being coming to UK since 1999 but never overstayed my visa. As I am getting married I will be flying back to my home country to change it to Fiancee visa. Does my fiancee need to give notice to Marriage registrar or Just have to apply for COA ? My fiancee is British National by birth.

Also how much time will it take to get spouse visa after we get married as i need to leave the country for my business commitment ?

As my business commitment needs travels does in future applying for ILR do I have to be in UK far all 24 months straight ?

Thank you

If you are applying for a fiancee settlement visa (which I presume you are) ...
Does my fiancee need to give notice to Marriage registrar or Just have to apply for COA
You won't need a COA - your fiancee visa is effectively permission to marry already. You will have to follow appropriate procedure for the registrar though (which I can't testify to as I used the CoE).
Also how much time will it take to get spouse visa after we get married as i need to leave the country for my business commitment ?
You could use a same day appointment for a premium in order to get around that.
As my business commitment needs travels does in future applying for ILR do I have to be in UK far all 24 months straight ?
Business travel is acceptable - but you have to show that you're in a subsisting marriage. Being out of the country the vast majority of the time might well count against you. But - going for citizenship has specific time out of country requirements and you should read up on this.

This actually leads to a wider topic as one of the requirements is that you need to show for the fiancee visa that you intend to live together permanently once married. Now, if you already have business commitments abroad, what is the likelyhood that you won't actually be spending enough time here for it to be regarded as a subsisting marriage?

Please also keep in mind that you can't be employed in the UK on a fiancee visa.

M.

You can't apply for FLR(M) from your home country. It has to be applied for from within the UK.

From home country, you may apply for a settlement visa using VAF4 form.

Why haven't you applied for Fiancee visa? Marriage visit is for those who don't intend to settle in the UK after the marriage.

As I have business and started a new one (IT enable Services) I need to travel so I called up VFS in Bombay for exact processing time they told me it will take five working day for fiancee vis for which i was ok. But when i went they told me i have to give notice and will take 10 working weeks I had arrange all venue the ceremony and everything here and paid up all. 10 weeks were way out of my marriage date so I ask the staff told him the situation they told me apply for marriage visit so I applied for the same. They granted me the visa for six months "Marriage / CP Visit"

Now my question can I change my Visa to CP dependent or settlement here or i have to go back to india and apply please advice

You have to return to India to apply from there and pay the fee for a Spouse/CP 27th month settlement visa. Form VAF4a.
Fiance would have enabled you to apply for FLR(M) from within the UK after the wedding. If you submit your application after the 29th of this month you will also have to comply with the pre-entry English test requirement before applying for your visa.
