Rejected work permit- appeal

I have just received news from my employer that my Tier 2 work permit application has been rejected. I have been all over the net trying to find info on the success rates and timescales of appeal. At this stage we still have not received the rejection report from the home office but need I need to know sooner rather than later if an appeal is a worthwhile exercise. Can anyone help?

What was the reason for rejection? Do you know anything?

The work permit was for what profession? One of my officemates appeal took 2 months. But it was back in October 2005.

I work in IT admin and procurement for a government body am still awaiting the report as to why it was rejected. Additionally the agency that we used was very confident of it being approved am was baffled at the rejection. 2 months can be a long time to wait tho...

was the appeal successful and if so do you know on what the reason was for the original rejection and what was required for the appeal??

They refused on the terms of advertisement....so the employer wrote to show the number of times they tried to get a 'resident' worker to fill the position. It was very lengthy. Lots of documentation was required and it dragged and dragged.......

We've received word that the application was knocked back because the post was not up to requirements and that I didn't have enough experience to do the job which is crap because I have been doing the job for over a year and have 5 years experience in the field.

Seems like a bit of a blanket excuse from the home office cos they didn't really state any specific reason. Needless to say we have already lodged our appeal.

hi.

i'm in the same situation as yours. my wp was rejected with the same reason on the grounds of insufficient advertisment to recruit a resident worker and my future employer in the UK has also lodged an appeal. what worries me is so far they have not requested any documents from my side. did your UK employer request for your academic references?

If one is already in UK under WP and moving a similar position under different employer - isn't it the case then new employer need not show 3 months employee search?

AFAIK, job advert & 3 months candidate search is required when the new employee is coming outside UK/EU.

Powergirl...

I was working in the UK on a working holiday and my employer wanted to sponsor me from there.. my application was a tier 2 (out of country) based on experience not and not on any academic references. So mine may be a little different.
In saying that I have over 5 years experience in the role (Home Office states a min of 3 required) of which was backed up with supporting documentation from previous employers. Additionally, my employer satified the advertisement criteria. As I worked for a gov body, I have never seen such as drawn out recruitment process. Anyway the home office stated that i did not have the experience to do the job (even though I had been doing it for over a year).
But that aside, you potential employer should have asked for you academic records and work experience. The working in the uk website can handy as it provides all the information required. THe guidance notes are particularily handy to infd out what you potential employer should be doing.
