EEA family Members Citizenship

Hello Everybody,

I was just trying to find some information in google about Citizenship in UK and found this wonderful forum. This is my first post to this forum and I am hoping to get some answer for my questions.


Please find the information below:

Date of Entry in UK: 21st Feb 2004
Visa Status:

**1 year visa as a dependent of EEA National (My Father is Belgian national) from British embassy in Abu Dhabi,

**After 1 year I got extension of 5 years, and it was finished December 2009

**In January 2010, I did apply for PR, which I have received on 3rd September 2010.

**I have spend only 35 days outside from UK since I came here in Feb 2004

**I have already passed the life in UK test.


My Questions are:

**Can I apply for UK citizenship straight-way or I have to wait till Sep 2011??

**My Mother don't want to apply for citizenship because she didn't appear in the Life in UK test. I am 21, and my younger brother is under eighteen, Can we apply at the same time, even if our mother don't want to apply for citizenship?

Are you a Belgian citizen? Or is he actually your step-father?

Assuming you can prove that your EEA father was exercising Treaty Rights in the UK for at least the last 6 years, you can apply now ..... assuming of course that you were physically in the UK exactly 5 years before UKBA receive the Naturalisation application.

I am struggling to think of a way that your younger brother can apply. Being under 18 he would not apply for Naturalisation, but instead the application would be for Registration. But in the absence of a parent applying for Naturalisation, or already being a British Citizen, I can't see how he can apply.

*** No I am not Belgian Citizen. My Dad is a Belgian national. He is not my step father. Me, my brother and my Mom are all non EEA national and we were all his dependants when we first entered in UK in 2004.

Well the application will be yours. I think you have a choice and either wait until you have had your PR confirmation for one year ..... sometime in September 2011 .... or alternatively apply before that .... but be prepared to again submit details from your father, proving he has been exercising Treaty Rights in the UK for at least the previous 6 years.

As regards your brother :-

He is going to be 18 in three years time.

-: unless someone can come up with an idea for him to apply for Registration as a minor, he will need to wait until he is 18, pass the Life in the UK Citizenship test, and then apply for his own Naturalisation.

For him, a shame that one of your parents does not want to apply for Naturalisation, because if they did make such an application, there would be a clear path for your brother to apply for Registration.
