SET-O or SET-M?

Post by timc » Mon Apr 24, 2006 9:32 pm

Hi folks,

I'm a Canadian who's been in the UK under a work permit visa from June 2003 and expiring June 2008. I had originally intended to wait until near the end of this term and then apply for an ILR using form SET-O. However, my wife is a British citizen and we got married in May 2005, with the ceremony and marriage licence issued from Canada.

Now I notice there is a SET-M form which states that a probationary 2-year period must exist before applying for ILR using this form. Does anyone know if this means that as long as I can prove me and my wife have been living under the same roof for a period of 2 years in the UK since I arrived in 2003, that I can use SET-M instead of SET-O? Would I still need to complete an FLR-M?

Thanks,
Tim
