UNMARRIED PARTNER VISA HELLLPPPP!!!!!!

Post by Confused21 » Wed Nov 03, 2010 9:56 pm

Hi,

My bf and I are planning on applying for an unmarried partner visa, however we think we might not have enough evidence required to meet this criteria as we've not lived together for a two year period even though we've been seeing each other since Nov 2008.

We've been seeing each other since 2008 but never really lived together (He lived in a very small apartment and I was still living with my parents as i couldnt afford to support myself or live away from home). However we've spent alot of time together and speak to each othr on phone like everyday. We've also travelled away for weekends and ive spent some weekends in his wee flat.:).

His visa is due to expire and he wants to apply as my unmarried partner (I am presently setted here), but we not sure how we can proof joint agreemnts, utility bills, lease agreements, council tax agreements etc as we've never lived together in the same adress. Below are the few evidences we've managed to collect.

- A print out of travel tickets
- A print out of hotel Bookings
- We are compiling our photos to print out (about 42 so far)
- Ive ordered a breakdown copy of my bills from Nov 2008 to proof our constant communications on phone.

So far this is all we can show as proof of our relationship. I have now just recently moved in with him (this month) and we planning on moving somewhere bigger.

It will be alot difficult if he goes back to apply from his homecountry and we really want to get this sorted out here. We not ready for a cvil partnership ceremony just yet.

So I need to know if anyone knows any other ways to proof our relationship is genuine as we are stuck with ideas??? Any ideas will be greatly appreciated.

Many Thanks.

The rules say that you have to have lived together in a relationship akin to marriage or civil partnership for two years, so you do not meet the requirements of the rules:

Leave to remain as the unmarried or same-sex partner of a person present and settled in the United Kingdom
Requirements for leave to remain as the unmarried or same-sex partner of a person present and settled in the United Kingdom

(i) the applicant has limited leave to remain in the United Kingdom which was given in accordance with any of the provisions of these Rules; and ......

(vi) the parties have been living together in a relationship akin to marriage or civil partnership which has subsisted for two years or more; and

You don't meet the rule, sorry to say.
I am not, and cannot, offer legal advice to particular people. I can only discuss general areas of immigration law.

People should always consider obtaining professional advice about their own particular circumstances.

Hi all, Many thanks for your replies.

His lawyer advised that this was an option for him, even though we told them we've not lived together for 2 years. But they said photos, letters emails etc of our communication will help. But we are worried about the lack of evidence and so not sure what to do next. We dont want to apply, pay lawyers, and then get rejected and funds deducted as we are quite skinto right now.

If he goes back to his home country and re-applies from there, we not sure of the chances there if the chances here are slim.

The only thing we have come up with is if he travels here as a visitor on instalments to accumulate the 2 year living together rule? But that means he cant work and its life wasting idling as he obviously has no job in his home country.

So what is the best possible way out to this? Any one aware of other options? If anyone has any suggesstions, that will be more than great for us.

Many Thanks for your advise so far.

The sort of evidence they prefer is specified on the FLR(M) form.
