I am writing to you to get some information about my friend who get the noice of leave UK.
He got married with British and after one year of living as a husband and wife they decide to get divorce because of bad behaviour of his wife. He has got spouse visa for 2 years expiring in March 2011. His ex wife already informed HO about it that they not together as a couple and he got letter from HO with information to leave UK. He appeal of this decision and only what he got was again his application. HO is telling and calling to him to get solicitor and i dont want him to leave UK.
I am with this man for 8 months. I am from Poland and already have my residecny. My question is: what we can do to do his documents right, what application we should fill it because we waiting only for his divorce and e want to get married and live in UK as a husband and wife. He is from Morocco . Hght all honest i dnt know what to do know as we want to be together and we want to make straight all his status.
He hasnt got his decree absolute and we just waiting for it and after we want to get married.
I will be very glad to get some help from you.

As soon as he received his decree absolute both of you should go to Poland and get married over there and you applied for his residency.

To stay in the UK he must first be divorced then remarry and apply for a spousal visa outside the UK either in his country or in yours.He will not be allowed to stay in the UK and change his visa status

ok so what we can do now? Coz when we went to citizen advice the person who is dealing with immigration told us to back in january (visa expire on march 2011) to apply on FRMS and doesnt matter that he hasnt got divorce yet. The lady told us that it doesnt matter and we can apply for it coz he is with me, living with me and wants to stay in UK as me. So nw im really confused and dnt knw what shall we do

Unfortunately the CAB isn't known for giving accurate advice about Immigration law. Mochyn is right.
