evidence for contractor earnings

Post by usman.shahid » Tue Nov 09, 2010 6:11 pm

I am planning to apply for Tier 1 visa.

I have a query regarding evidence I need to provide for income i earn as a contractor. I am an IT professional and have worked as a consultant with an XYZ company and they have paid me in return of my services. I dont operate my own company but work as an idividual contractor and provide consultancy on contract basis. Please advise what documents should I attach with the application as a proof of my earnings as a contrator. I am considering following documents, are they sufficient ? I am also a salaried person but besides salary i have to include income i earned as a contractor to gain enough points.

1. bank statement highlighting the credit payments from client
2. letter from the client/company i have provided consultancy
3. letter from accountant

please reply.

For income through self-employment:
Reference to the policy guidance - choose 2 from 141(vi)-141(ix), taking into account 141(x). Also provide 2 from 142(i)-142(vii).

If you have not registered as self-employed with HMRC, you cannot claim points for income earned through your "unauthorized" contract work.

Are you properly registered for tax and NI? Those documents are essential.
I am not, and cannot, offer legal advice to particular people. I can only discuss general areas of immigration law.

People should always consider obtaining professional advice about their own particular circumstances.

I contract through my own limited company (ie, I am an employee of the company and receive salary and dividends).

Am I considered self-employed for the purposes of Tier 1 earnings?

I don't receive payslips so I am planning to provide:
(1) Personal bank statements
(2) Letter from accountant stating gross and net salary and dividends
(3) Two forms of evidence from s142

The accountant letter will not include the invoiced amount, only the amounts paid to me, and the invoices are just Excel spreadsheets sent to the client with my timesheet. I'm not sure why they are required or what they are intended to prove.

Are invoices always required if an accountant letter is used? Why?

Alternatively, I might provide:
(1) Personal bank statements
(2) Business bank statements
(3) Two forms of evidence for registration for HMRC from s142

Would this be satisfactory evidence?

I am not in UK already, I am planning to apply for initial Tier 1 for first time. I am not self employed and is not operating my own company, rather worked as individual contrator.

Earnings from "individual contract" work is income from self-employment - irrespective of whether you operate through your own company or otherwise.

Since you are applying from outside, ignore para 142 of the policy guidance. Rest of the documentary evidence(s) remain as suggested before (above).
