ILR and traveling to UK

Post by Sam123 » Wed Apr 26, 2006 3:48 pm

Hi all

I need your advise please regarding ILR. Once I get ILR, can I come and go back to my native country any time or is there limit on my movements for certain number of years? I am not looking for British Passport.

Your all suggestions will be highly appreciated.

thanks
Sam

So long as you don't stay away from UK for more than two years, yes.

You might like to bear in mind the following snippet from the UKVisas website:
If there is clear reason to doubt that the applicant can be treated as a returning resident, enquiries necessary to establish the applicant's intentions should be made. For instance, persons resident overseas cannot maintain their settled status in the UK by paying short visits before resuming residence overseas. In such cases the applicant should be treated as a visitor.

I am planning to set up business in my native country and could visit UK once in a while or my children can visit later in life. Is it allowed or not?

I'm not sure what part of my earlier post was unclear, but no it isn't allowed. When an ILR holder returns to UK from overseas, he/she needs to be resuming residence, not popping in for a quick visit.

No. You have to treat UK as your home country then only you can keep ILR.
If you use ILR just to visit UK once in a while it can be cancelled by the entry clearence Immigration officer on arrival in the UK and you will be treated as a visitor. Then you need to get a visitor visa every time you enter the country.
