EEA2 Housing Benefit Advice pls!!!

Hi All,
I ve asked this question on Benefit section with no reply so I ve decided to post it here hoping someone will help out.
Wife is Dual Irish/British so went through EEA2 route.
Question:
We are about to apply for Housing Benefit while my application is still on going as I ve lost my job but she still works part time, Will it be counted as public fund?
Any advice will be helpful. Thanks

The question is not whether it is a public fund or not but rather if you can claim without affecting your residency, see Chapter 12 of the ECIS.

After going through it... I'm made to understand that as long as she is exercise her treaty right, its not consider as public fund. Hope am not missing something there? loll

HB is a public fund whether your wife is exercising treaty rights or not. What you need to ascertain is whether she is eligible to claim it without being considered a "burden on the state" and hence affecting her (and your) rights of residence.
