help needed

Hi everyone
I'm new here, but really in need of advice.
I'm totally confused about my boyfriend's visa so if anyone can answer I would be so grateful.

Basically he is Tunisian. We have been together 1 year. He was married to a German woman for a number of years which led me to assume he had an EEA visa. However, he says that he doesn't and instead has a permanent residence visa for Germany. I don't understand why he hasn't got an EEA visa. I thought you got it automatically if you were non-EU but married an EU citizen. That is query number 1.

The most important issue, however, is, having this permanent residence visa, can he travel to the UK for a week's holiday? He is out of work at present (but looking hard for one in Germany) but he does have a job offer for April of next year, with the same company he has worked for every summer for years, in Germany. The googling I've done suggests that as he has permanent residence but not the EEA he can't travel to England for a holiday. Is this the case because I can hardly find out anything? He is so busy job hunting I said I'd do the research.

I would be so appreciative if anyone can help me sort out this muddle. I'm about to go out there anyway but I'd still love him to come here and show him round. Many thanks in advance

Did he and his German wife live in Germany? If so, he wouldn't have an EU visa.
I am not, and cannot, offer legal advice to particular people. I can only discuss general areas of immigration law.

People should always consider obtaining professional advice about their own particular circumstances.

If he is a visa national (and he probably is) he will need an appropriate entry visa. He will also need to show his intent to return and sufficient means for his stay. Being unemployed is not a very good starting position.

If he is resident in Germany he wouldn't have a visa but rather a residence permit. From what you say his permit is probably issued under a EU directive but that won't help him regards the UK.

Thank you so much for the replies.
Yes, he and his wife lived in Germany.

I think it's as I suspected. It's not going to help. I have to just try to accept that and have a think about whether we have a future or not based on this. I've seen other partners of Tunisians struggle big time with visas and it is so very stressful
