Need Suggestion - dependent visa new born baby.

Post by karpu » Fri Nov 19, 2010 3:50 pm

Hi Team,
Once again I need help from experts. In the past with your help I got my Tier1. Me and my wife are on Tier 1. Me as a DEPENDENT and my wife as a PRIMARY applicant. I got an opportunity to work in UK for one of the company and we came to UK and I have join the company. As my wife is pregnant I have sent her back to India. She was working in India for TCS. Now she is on maternity leave and the delivery date is in the month of April 2011. Once we have a baby we have to go for dependent visa for baby. Now as she is primary applicant I would like to know the process. Though I am dependent I am working as full-time in UK and my Job is perfectly fine.

Could anyone have a thought on this, or have you seen any such cases in the past. This is too early to ask this question, but, looking at the changes for Tier1 I want to plan in advance to avoid any hiccups at the end.

Same process that you followed to apply for dependant visa earlier.

In the long term, what are you going to do? If your wife's been working in India, she won't easily qualify either for a Tier 1 extension or for ILR.
I am not, and cannot, offer legal advice to particular people. I can only discuss general areas of immigration law.

People should always consider obtaining professional advice about their own particular circumstances.

Hi Team,

Thanks for you valuable updates on this please find my plan of action below,

• I am not worried about my wife job in UK (though I am dependent) as I am having a permanent job here in UK. Hope this will continue till my visa ends i.e. 2013. And no problems for funds.
• My wife is still working with Indian and she is having her job and presently she is on maternity leave.
• She is maintaining sufficient funds in her account for dependent visa application for our child. Date is given in the month of April 2011.
• After child birth she can go for a visa after 3 months i.e. July.
• If we want to extend our 2013 Tier1 Extension she needs start work from March 2012.
• We still have chance of getting the extension in 2013 (if rules are not changed).
• I am pretty confident that she will get a job as she is into C++ and Unix.

I am now just worried about my child visa that my wife can go with sufficient funds statement in the bank and birth certificate. Or do we need any other documents. I don’t think that I have to send my offer letter and pay slips and bank statements because I am a dependent it won’t be taken into consideration.

If 2013 by any chance if we have not extended our visa then we will go back to India.

Gurus please suggest your thoughts on my plans.
