Non payment of tax etc by employers

Post by mary-jane » Sun Nov 21, 2010 10:08 am

Help!
I came to UK (II am from Philippines) with my Indian emoployers as their housekeeper from Hong Kong where I had worked for them for eight few years.
They held my passport adn paid me cash but did let me go home to get married.
I have permission to reside and work in UK. (I went home and married in the Philuippines a year ago Then (Dec 2008) I acquired a National Insurance number.
My employers thought they were leaving so I got a new job with nice Swedish couple who want to pay me regulary, pay my tax and Natiional Insurance BUT previous employer who I still work for one day a week won't admit they have been employing me (I lived with them until September this year.
How do I tell theauthorities and what should I say - I have no paperwork since I arrived in UK in 2008 and my employers won't give me any!
Any advice very happily received!!
Thank YOU.

See this page:

http://www.ukba.homeoffice.gov.uk/worki ... icworkers/

The guidance is here:

There is also a charity that works with domestic workers:

http://www.kalayaan.org.uk/

I hope your initial employers were paying you the national minimum wage.

You are brilliant! - Thank you very much for the very helpful links.
One thing more please, does an 'officially declared' 25 hours a week count as full-time?
My first employer gave me no paper-work, just cash at the end of every month. The new one only gives me paper-work for 25 hours even though I work a full week...?

mary-jane, I suspect that you might be thinking of reporting Tax and NI fraud, and if I am right .... click here.

No. I just wanted to make sure that they were not doing anything that will jeapodise my visa extention and that 25 hours counts as full time[/b]I realise from talking to other workers that almost all domestic workers in my position seem to have 'non-official' arrangements with their employers. I like my new employers. [/b]

You call them a nice Swedish couple who are you new employers. I am sorry to say this but if they are not paying you the national minimum wage I don't think they are very nice at all. I think that is disgusting. They should also be paying the proper amount of tax and national insurance.

You may find talking to the charity helpful. I can understand why you just want to get your visa extended, but perhaps you can talk to them later.

I would get your pay put in your bank account, you could say to them that you do need to build up a good credit history for the future.

I don't explain well.
They pay me o.k. but only official for 25 hours week (150 pounds) the rest is cash 'extra' and 'non official'.
I worry that 25 hours won't count as full time for the visa.
You are very kind to spend so much time helping!

Still not good, they should be deducting national insurance and your income tax on the whole amount and then paying that to HMRC. Do you pay national insurance?

25 hours doesn't appear to me to be full-time work.

In addition, you are involved in a tax fraud conspiracy.
I am not, and cannot, offer legal advice to particular people. I can only discuss general areas of immigration law.

People should always consider obtaining professional advice about their own particular circumstances.
