Sorry to be a bother to you guys but I'm getting nowhere searching on the board for a suitable answer.
here is my situation...
I'm a British Citizen, receiving 'disability living allowance' ( mobility). I have heart problems, diabetes etc.. etc .. & etc.
My wife is a Canadian citizen. We were married here in the UK 2 years ago when she came over on a Fiancee vise ( to get married) then she went back to Canada. She was given here spouse visa in July 2010 and she arrived here in the UK in early August.
In late August I had a heart attack which left me very weak and three weeks late I was in hospital once again for gallstones and am waiting for an oporation now.
My wife is working part time getting 7500 pa.
we had some savings which are all vertually gone.
Being a British citizen I applied to the DWP for 'Employment & support Allowance' and made it clear I was claiming for myself only as my wife was not a british citizen and as such was not allowed any money from 'public funds'
They have said that I am not intitled to anything because... 'you have as much or more money coming in than the law says you need to live on'.
which they've broken down as..
your living expences ..................... 65.45
extra money because of disability .... 25.95
give total support as ...................... 91.40
Other income for your household .... 126.06 (money from wife's p/t job).
So as the household income of 126.06 is greater than 91.40 that I would be getting... I get nothing.
We have a small mortgage to pay, all the usuall utility bills, credit card bills, council tax bills etc...
I want to work but can not because of my body. My wife is having to work and look after me at the same time.
Can someone please explain this all to me. Is the DWP correct in their reasioning? What a miserable life I've gotten my wife into.
