Travelling around EU with Stamp 4

Hi everyone.
I have the following problem. I've got temporary Stamp 4 which expires next january and suppose to be substituted with Stamp EU4 fam (my spause is EU citizen, I am-non EU)

We've booked a trip to Spain for 18th of December not checking the requirements for Spanish shengen visa one of whcih is

Irish Certificate of Registration (GNIB card)
(also known as Garda/ Green Card), valid for at least three months after the date of expiry of the visa applied for.

Oops!...

I feel a bit frustrated now as apparently I need to spend Christmas in Ireland + loose 500 euros on tickets :shock:

Spanish embasy is not very communicative. Ive applied for the appointment 1 week before (20-22th of November) The closest availible date was 8th of December, + making visa takes 15 days :shock: that makes things even less possible.

There is no physical person who can talk to you even through the phone.

Ive written the email to the EU treaty right section, but it will probably take some time to hear back fron them, as they dont talk through phone or email nither... also wrote to solvit.

I called to the embassy of my spouse state, they ae quite friendly and ready to issue me with visa if I provide them with tickets to their country. But we've already booked Spain!...

Guys, any advice on what else can I do to save our vacation?

Do they a need a visa?
If your family members are non-EU nationals, they can accompany or join you in another EU country. They must carry a valid passport at all times and, depending on the country where they are from, they may also be required to show an entry visa at the border.

Your non-EU spouse, (grand)parents or (grand)children do not need a visa if they:

have a residence card from a country in the Schengen area and are travelling to another Schengen country, or

travel with you and/or wish to join you -and have a residence card issued by an EU country other than the country of which you are a national. This would be the case if you are living in another country. The residence card should clearly state that the holder is a family member of an EU national.

I think the second one applies to your case. Once you are with your EU spouse it would not be a big deal convincing Spanish Immigration Officer when you are in Spain in my humble opinion, the main stubmling block would be the airline allowing you to board as most of them haven't got a clue when it comes to EU fam rules.

Hi ChikyPicky,

you are legally allowed to travel without the 4EUFam-card, however without a visa this can sometimes be a bit tricky.

Since you already booked, I suggest you read the following

with great attention to detail. Follow every link and KNOW the details by heart. Print the law and take it with you.

It may be a good idea to inform the airline about your situation long before you arrive to the airport, so they will already know you and about your situation.

It would be illegal to refuse you boarding at Dublin Airport. Should this happen, you would be in a position to recuperate your costs in court. Make sure to take proof in one way or another that you were actually refused access to the plane. (Try to get it in writing, if this is refused be sure to film the actual refusal, wherever it may occur. When filming, make sure to conveniently pass over a newspaper of that day to prove the date!)

Once you passed Dublin, next problem will be arrival in Spain. For that I suggest you take a copy of the law in Spanish, and don´t expect them to speak English there. Highlight the appropriate paragraphs of the law in the Spanish text. You can identify them by their numbers, even if not speaking any Spanish.

This is quite risky scenario :D Does it take a lot of time and effort to suit them? Never had this kind of experience. Id never guess that its more difficult to travel from EU to EU then from outside to EU
I have an apointment with Spanish embassy next week.I dont even know what to talk with them about... They will definetely claim that I cant travel to Spain. Any ideas? or is it pointless?

It seems we can change the dates of tickets loosing 70 euro only, so we might just give up on this Christmas plan. :?
