Tier 2 dependant opening self emplyment or company

I am holding Tier 2 visa and my wife is tier 2 defendant wanted to start up self employment business or register as company.

Can she employ me as a volunteer employee under her self or company registration. As I hold Tier2 can work any volunteer jobs maximum 20 hours per week.

Appreciated for response.

AFAIK, a volunteer cannot be the employee of the organisation he/she is volunteering for.

Likewise, never heard of the term"volunteer employee".

A Tier 2 binds you to a specific company and you can legally work ONLY for the company that sponsored your Tier 2 - whether its volunteering, profit or non-profit has no bearing.

I maybe incorrect here but do check the legality of the matter first before going down the route of registering a company - be it you or your wife. Tier 2 dependants can work for any company while the main holder is here but really not sure if Tier 2 dependants can open a company. Pretty sure that you being on Tier 2 does not allow you to work for anyone else other than your main sponsor

I guess you should be able to do so, but I am not sure, basically it says that you can work as a volunteer (of course it will have to be same job title) for 20 hours or a part time employee. I think there is nothing illegal about doing so, but you can be either an employee or a volunteer, of course if you are a volunteer, then you cannot be getting payslips, good news is you will be paying tax once.

The only problem is that your company cannot have a profit from volunteer work, and because all of its employees are volunteers so basically, this must be by definition a non for profit gain organization, so now your spouse is in trouble.

The other legal alternative is properly hiring you in the company which is quite a long process and it again has to be same job title and contract for a maximum of 20 hours, but then you will pay taxes and the company will pay taxes, and so you will end paying alot of taxes and National insurance for you.

That all if you are allowed to work in this company, so i guess you should call them and ask about this.
