spouse of a permanent residence eea national

hi,

I'm a Non-EEA National that has recently got married, my wife an EEA National has exercised treaty rights here for the past 6 years. Would I be able to apply for further leave to remain as a spouse of a settled person FLR(M) under UK Rules, even though she has not formally applied for permanent residence.

If you provide proof of your spouse's permanent residence, then you may switch (284).

Hi Vinny,

Thanks for your quick response, I'm a bit worried that if my wifes goes ahead and makes an application for permanent residency(EEA3), by the time its confirmed by HO, my Visa would have expired. Considering the time constraints..

1) Is it mandatory that she receives confirmation of her residency before I can make my application?

2) Would it be possible to submit my application-FLR(M) along with her P60's/Payslips for 5 years as proof of her permanent residence?

I'd really appreciate your advice.
