Switching From Student dependent to Tier 1 HSMP

Switching From Student dependent to Tier 1 HSMP

Dear All,

Currently I am on student dependent VISA (Tier 4) and I will be eligible for Tier 1 HSMP Visa in 1st week of March 2011, Now my question and confusion is - :roll:

1) Can I apply for Tier 1 HSMP Visa within UK or not? Because some people say I have to go back to my home country for entry clearance.

2) I came to UK in November 2009 and my Visa is valid till January 2012, as till date there is no certainty about PSW I want to apply for HSMP as I will qualify for the same - But if my Visa gets rejected can I apply as a PSW spouse dependent Visa ?

3) If my wife also apply as HSMP dependent (Tier 1) from her current status Student Visa (tier 4) – can she apply with me within UK?
And what are the impacts on applying PSW after her studies, if HSMP visa gets rejected.

Your efforts and reply will be deeply appreciated.

1. Yes, you may switch (apply from within the UK).
2. You may switch from Tier 4 dependant to Tier 1 (PSW) dependant at the same time as your spouse or soon after your spouse is granted leave as Tier 1 (PSW) migrant.
3. Your spouse cannot switch from Tier 4 to dependant of Tier 1 (General). This can only be done from outside UK.

Hi,
Firstly, there is no HSMP anymore, its called Tier 1 (General), I am not sure about switching from student dependent to Tier 1 within the country but there are certain categories that are allowed to switch like PSW, WP holders.

In my opinion the PSW and the T1 (G) that you are going to apply for, would be evaluated seperately and on seperate criteria so you should not be worried about the affect of T!(G) rejection on PSW unless you submit any fake or forged document with T1(G) in which case you might be banned for 10 years. If only you don't meet the criteria for T1(G) then you should not be worried about PSW visa as long as you qualify for it.
