Doesnt it mean the band rather then salary itselft. Quite frankly I cant remember what exact figure I showed in my app!!suresh.k.dasari wrote:Hi All
I have read the following on the UKBA Home Office Website in regards to applying for Settlement/Residency :
• There will be a new criminality threshold, requiring all applicants applying for settlement to be clear of unspent convictions.
• Skilled and highly skilled migrants will need to meet the salary criteria that applied when they last extended their permission to stay.
• All migrants in an economic route will be required to pass the 'Life in the UK' test prior to gaining settlement.
I showed £27,500 salary for my renewal of HSMP from 2 years to 3 years and this was done on Oct 1, 2009 last year. I am eligible to apply for a Permanent Residency on Oct 1, 2012.
From the above as per the second clause which is marked in Red colour does it mean I have to again show £27,500 of salary at the time applying for residency on Oct 1, 2012? My current salary is £24,000, do I have to start looking for a new job that pays me above £27,500?
Is it likely for the above rules to be changed or amended? Will the above legislative rules definitely be passed in April?
Thank You in Advance
Suresh
All it means is you will be subject to the same earnings criteria (read salary bands) for ILR as you were subjected to, at the last extension. If someone now earns less than what they used to when they got their last extension, they should be fine as long as their earnings at the time of the extension earns them the same point as they earned at the time of last extension. For example if you earned 40 points from earnings for your salary which was GBP 35k on a salary band of say 30k to 40k then come ILR, as long as you are earning 30k, you should be fine. Thats my read of the information available on UKBA website but we need to wait till more definitive and detailed info is provided.psdesai wrote:Doesnt it mean the band rather then salary itselft.
