Is dependant visa conversion necessary? Request urgent help!

Hi,

I am in UK on tier 4 and intend to convert my VISA category to tier 1. Do I need to necessarily file for visa category change for my daughter along with my visa conversion application?

My spouse (Indian) has tier 1 and my daughter (US citizen) has tier 4 dependant visa. They are yet to come to UK. My spouse and my daughter intend to stay just few (2 to 3) months and might go back to US after that.

Is there a way we can avoid converting visa category for our daughter. Since I am filing my tier 1, would visa agency expect me to file her conversion along with me (she is my dependant)?

Considering current situation, purpose of my spouse is to visit (rather than work which was orignally intended). My daughter is a US citizen and does not need visa to visit.
Which of the following might be best?
1) File Tier 1 dependant even if it is only for 3 months visit (and is costly)
2) File visitor visa for my spouse and hence indicate that my daughter is just a visitor along with
3) Do not file any visa and inform office at port of entry that they are visiting country just for few months even though my spouse has tier 1

Please suggest. Any other suggestion will be greatly appreciated. Thanks

If you can prove returnability, then Option 2 is the best, given what you wish to do. But do note that an entry clearance as visitor will invalidate your spouse's Tier 1 (General) visa (for sure) and, perhaps also, your child's Tier 4 (general) dependant visa.
