Can a previous overstay lead to rejection?

My girlfriend is applying for a student visa from Brazil. She has lived in England before but she overstayed her visa by 5 months. From what I have read on this forum it sounds like that should not count against her because she left voluntarily and it was over 1 year ago. However her migration lawyer in Brazil is now telling her that her application may be rejected because of the overstay. Is he just incorrect on this or is there a chance that it will count against her?

Any advice would be much appreciated!
