AIT appeal process

Dear forum members

I will be thankful if someone could guide me about step by step appeal process written in simple English? Is there any process flow chart explaining this?

I went to AIT website but could not find any guide which is suitable to understand for layman like me. I need to know what steps are to take when immigration application is refused and how an appeal can be lodged? And what formalities to complete after lodging the appeal?

My questions are:

1. What documents to send along appeal form?
2. And what is the dealdline of sending the documents?
3. Can additional documents be sent with the appeal? If yes, then what is the deadline?
4. Can grounds of appeals be given later after appeal is lodged?
5. What are addtional grounds of appeal?
6. Shall appeallent submit original documents or just the photocopies?
7. How to get the adjournment on paper based appeal?
8. What is the difference between paper based appeal and oral hearning?
9. Does oral hearing increase the chances of success?
10. What is the wittness statement? And when to give it?

I look forward for your feedback.

Anyone please...

I think lots of members have gone through appeal process. Would appreciate if someone could provide guidelines and share his/her expeirence of handling appeal.

That will be helpful and guideline for me and for many future people filing their appeals.

You need to send appeal notice and refusal notice. The appeal needs to be completed by yourself or your legal reprsentative. You can send any documenst to prove your point on which you were refused


2. And what is the dealdline of sending the documents?

28 days after receipt of Refusal notice


3. Can additional documents be sent with the appeal? If yes, then what is the deadline?

Any additional documents must be submitted within 28 days along with appeal form

4. Can grounds of appeals be given later after appeal is lodged?

No


5. What are addtional grounds of appeal?

Reasons you feel the ECO did not take into consideration when deciding your application

6. Shall appeallent submit original documents or just the photocopies?


Preferably originals if available if not then copies can be submitted


7. How to get the adjournment on paper based appeal?

Informed AIT as soon as possible and ask them for oral hearing



8. What is the difference between paper based appeal and oral hearning?

Paper hearing is when teh adjudicator makes a decision based on loooking at documents only.

Oral hearing is where you attend to give evidence. Oral hearing are best if you or your rep can attend,so you can listen and argue your points infront of adjudicator


9. Does oral hearing increase the chances of success?

Yes for above reasons


10. What is the wittness statement? And when to give it?

Witness statement is required when you want someone else to back you up on some evidence that is important to your appeal. ( eg witness to sya that you and your fiancee did meet each otehr at certain time and place)

Witness statements are sent with original appeal form
