Switch my Tier-2 ICT Dependent Visa into Tier-1 General Cate

Situation:

I have come to UK as a Dependent under Tier-2 ICT Category. I am interested to Switch my Tier-2 ICT Dependent Visa into Tier-1 General Category Visa. My Spouse is not eligible based on Point Based Calculator. How ever I am eligible.

Question:

Can I apply as the mail applicant to convert my Tier-2 ICT Dependent Visa to Tier-1 General Category and keep my Spouse as my Dependent (who is the main applicant for Tier-2 ICT).
