getting married, need right visas!

Post by os_oz » Mon Dec 13, 2010 4:32 pm

I am an Indian citizen and my partner who I am getting married to is British.

My visa history has been something like this:
2004-2005: Student Visa
2005-2007: Fresh Talent Scheme in Scotland (which has now been dropped)
2007-2009: HSMP
2009-2012: Tier 1

The problem is this - next year, August, 2011, we are planning to go live in India for a couple of years, and then perhaps come back to the UK. However, I am a bit weary of paying a lot of visa fees when my partner comes to India and when I come to the UK. So, any advice on what we both can be doing/applying for? I've been reading loads of stuff from spouse visas, PIO, OIC, citizenship etc, but am, still so confused!

Advice much appreciated, and thanks for reading :)

Satisfy the KOL requirements before you depart for India. Subsequently, you may apply for a spouse visa if you want to return to settle in the UK.

thanks, how long is the KOL thing valid for? Wont it be easier for me to just do it when I want to get back in a few years?

Secondly, any advice on what visa my soon-to-be husband should be getting for India? I am told the he cant get a PIO card until we've been married for 1/2 years. And he can only get a tourist visa (and not an entry visa) - but apparently with the tourist visa you for India, you need to leave the country for 2 months every 180 days!!

Any advice appreciated. I just dont want us to be in a situation where we cant be together because of visas!

There is no expiry. It may enable you to have an ILE endorsement on your spouse visa if you spend more than 4 years together outside the UK.

Thanks re the info on the KOL - I'll make sure I do that before leaving, since we'd more than likely be away for around 4 years.

And apologies re the wrong forum!
