tier 2 COS request

FACTS:
i) psw holder working for a company for last 8 months.
ii) company has applied for sponsorship licence, and expecting it to be class "A"
iii) salary band -> 20 k - 24 k
iv) non-shortage
v) will be applying from uk

QUERY:
i)resident labour test??? yes or no? apparently its a definite "no" when you are reading psw pages on ukba website , but "maybe" when reading pages from employer's perspective regarding COS application etc. am i right?

if RMLT evidence is required by ukba, can it be done while im already doing the same job (as i have psw visa) that is being advertised? or do i need to quit my job, let the sponsor conduct RLMT and then take me on as a psw holder but obviously mention it in the COS application that RLMT ws conducted. im a bit confused here, to be honest.

im thinking of asking employer to get it done, as it can only make my case stronger!


ii) what will it be like after april 2011 when long-term limit is applied(as opposed to interim limit)? more stringent? should i wait until then and hope things improve as they might have learnt from their mistakes since july 2010 regarding their adhoc policies??

iii)lets say, i earn 20k by working 37 hours a week. if i earn 24k by working 45 hours a week, which band will i be in? i guess my question is as far as ukba is concerned how much am i earning per week? does it matter how many hours it requires me to earn enough to be in band E?

Salary is at or above £40,000 - A.
Salary is between £36,000 and £39,999.99 - B.
Salary is between £32,000 and £35,999.99 - C.
Salary is between £28,000 and £31,999.99 - D.
Salary is between £24,000 and £27,999.99, - E.
Salary is between £20,000 and £23,999.99, - F.


please give my query little bit of your thought, especially those who have gone through the system once, regardless of the outcome.

It is very unilikely your company wil be granted a COS for a non shortage occupation and a salary of 20-24k.

The last 2 months they have only give them for salaries of at least 32k.

I'm pretty much in the exact same situation as you. Have you been rejected for CoS yet?
