The end of the beginning or the beginning of the end ?

Post by simplesteve » Tue Dec 21, 2010 11:20 pm

Need some information. My visa was rejected, it went to the to the First-tier Tribunal, which the judge allowed. The home office appealed to the upper tribunal , ' an error of law' I believe it was. The second judge also allowed my appeal. My question is, What else has the home office got under their sleeves as I want to start making important decisions regarding property/job-wise but am not sure what could be there next move... can they appeal the upper tribunal to another one also ? Am tired of this.

AIUI, if UKBA wishes to challenge the decision of the Upper Tribunal, they may seek permission to appeal the decision in Court of Appeal.

I would suggest speaking to the immigration experts who assisted you with the successful appeals. If you won them yourself, kudos to you!

The HO can potentially take it further to the High Courts or even ECJ - it really depends on the whether or not they are willing to take it all the way through and their opinion will depend on the previous judgements.
