Removal of 245B

Post by mulderpf » Thu Dec 23, 2010 11:56 am

Paragraph 245B of the immigration rules used to state:
All migrants arriving in the UK and wishing to enter as a Tier 1 (General) Migrant must have a valid entry clearance for entry under this route. If they do not have a valid entry clearance, entry will be refused.
It was deleted with the changes which are effective from today. The other changes in the immigration rule simply removed any reference to being able to apply for entry clearance and you pretty much have to have clearance already before being allowed to apply (e.g. switching).

The removal of this paragraph bothers me just a little though. I know I am just being paranoid, but can someone give me a good reason for them removed that paragraph?

You think too much, just because T1 (G) overseas application no longer exists. Simple as that.

Why does it bother you?
I assume you *WILL* have a valid entry clearance when entering UK. So the above removal does not affect you anyway, right?

It bothers me only because I don't really understand why it had to be removed, rather than worrying that I will be denied entry once I get there with a Tier 1 visa. I won't be having sleepless nights over it, I just want to understand why they would remove it.

Do you mean you were rejected to enter UK with a valid T1 G visa?

No no. This was removed together with the other 23 December changes. I applied for a Tier 1 General visa, but I have not yet entered the UK on it.

As I said, I'm not worried about it, just slightly bothered as to why they would remove it.
