Tier 4 queries

are there any chances of getting tier4 student visa and tier 4 student dependent visa rejected ( if we(husband and wife) apply at the same time ) based on the reason like " we are not satisfied that you are coming to UK genuinely for studies purpose only.I doubt you are coming here for working to settle in UK.So we are rejecting your visas". Are there any cases earlier like this.

Sponsor is legal guardian only.why i am asking this question because.My tier1 general got rejected earlier on 245 (c) section. So if we apply for student visa , they might be getting doubt like I am planning to UK with tier4 dependent visa for working purpose.

"Intention" is not a requirement under the immigration rules - however, you must attend class on a full time basis at the educational institution or you risk having the visa revoked. In respect to your previous refusal, if the reason(s) was simply because you did not score enough points, then an application for a student visa is quite straight forward. If however, you were deemed to have used deception or something along those lines, the case will be much more difficult as paragraph 320 of the immigration rules may apply.

I have heard of a similar case, where in order to try remedy the situation, you will need a statement from the HR confirming your employment details and that no intention of deception was used. It would also be useful to provide further statements of support from managers/directors of your company.

A personal statement from you will also be beneficial, stating the facts of the previous case. You may also wish to add in some Article 8 arguements.

Deception is a serious matter and you may wish to call on professionals to assist you with making such an application.

My case is not deception case. This all happened due to miscommunication.

My tier G visa got rejected on 245 ( C ) . I am not sure How it effects my wife's tier4 student visa and my tier4 student dependent visa. can you please me based on this info

Post entire text of refusal letter (excluding any personal details). Only then will people be able to suggest if any previous refusals may affect future EC application(s).

Without detailed information, you may not get accurate suggestions.

Exact Tier1 G refusal reason :

I have refused your visa application on this occasion because I am not satisfied , on the balance of probabilities ,that you meet all of the requirements of the paragraph 245C of the immigration rules . This decision was made on the merits of this application . How ever if you have previous application and immigration history this may have been considered.


We have assessed this evidence and you may have able to claim 35 points.How ever you have been awarded no points because contradictory information about your employment was revealed during checks conducted by this office in connection with this application.


You have not accrued the points required under attributes .I there refuse your application under paragraph 245C of the immigration rules.

Please help me urgently .

Do I require to submit the support letter and letter from me stating facts happened for this refusal while applying tier4 student and tier4 student dependent visa.

Thanks for clarifying the refusal.

Yes - I would recommend you submit letters of support, as well as a personal statement. If possible, to include your employment contract and payslips at the time of the initial application (which resulted in the refusal) to clear up the employment issue.

You were probably refused under the general grounds of refusal as stipulated in paragraph 245C.

The letter should come from the HR person in question, which should include details in the form of a statement, that he/she made an error in terms of your employment history. I think it would be beneificial to obtain letters from the director/manager of the company, to confirm and support the HR's statement.

Your personal statement should include details of your employment history and as your wife will be the main applicant, although her application should not be affected by your refusal, she too should include a personal statement to cover potential article 8 arguements.

Do I need to submit my current employment details while applying for tier4 student dependent visa.

The only documents I recommend that you submit in terms of employment are those which are relevant to backing up the period in which the IO raised issues in your previous refusal.
