REVOKING ILR GAINED BY DECEPTION

HI
A FRIEND OF MINE HAS BEEN CONTACTING THE HOME OFFICE AS HER HUSBNAD USED HER TO GET HIS ILR. HE LEFT ONCE ILR WAS GRANTED THE PLOT THICKENS AS HE GAINED HIS ESOL CERTIFICATE FRAUDENTLY BY PAYING A COLLEGE FOR IT. THEREFORE HIS ILR WAS GAINED THROUGH DECEPTION ON 2 COUNTS. MY FRIEND HAS WRITTEN TO THE HOME OFFICE WITH SUPPORT BY HER MP BUT BECUASE SHE HAS DECLARED THAT THE MARIAGE IS OVER SHE IS A THIRD PARTY TO HIS APPLICATION THERFORE DUE TO DATA PROTECTION SHE IS UNABLE TO KNOW THE PROGRESS OF THE INVESTIGATION IF ANY. SHE HAS PROVIDED EVIDENCE BUT HER EX IS STILL HERE SHE HAS BEEN WRITING TO THEM FOR OVER 8 MONTHS NOW

WILL THE HOME OFFICE DO ANYTHINK? PEOPLE HAVE TOLD HER THE HOME OFFICE ARE SLOW TO ACT IS THIS RIGHT?

The wife may allege deception on the grounds of desertion after the grant of ILR, and may well be right, but proving what someone's intentions were at the time of application is notoriously difficult, and I suspect that no action is likely to be taken on these grounds.
However, fraudulently obtaining a certificate is more likely to gain their attention, but her allegation may now form part of a larger investigation and there's no saying when or what action may be taken.
She has done the correct thing by reporting her suspicions, but she would be well advised now to put the matter behind her and start rebuilding her life. Waiting for retribution in the form of action by UKBA is only likely to leave her more embittered.

Unfortunately the authorities may look into when your friend was aware her husband obtained his ESOL certificate fraudulently and when and how she came by the information. Before or after the application? If it was before, then she could be implicated in the deception and in supporting a fraudulent ILR application.

One of the things i love this country for is that they will not act instantly on mere information that you gave to them.
You will have to produce evidence to support the claim.
they will do a lot of investigation as well.

the fact that MP wrote them is not sufficient enough to butress the claim.They will tell you that each case is treated on its merit.

why is it that in some cases when an individual lodge complaints at police station,the person that lodged the case eventually became suspect and later the accused.Home office will do the same thing like police as well

Proper investigation has to be carried out.

I am also learning,please forgive me if my comments sound offensive
