Tier 2 to Tier 1 in March

Post by anotherguy » Fri Dec 24, 2010 11:57 am

Dear Senior members,
I am on a Tier 2 visa now and plan to apply for Tier 1 General in the first week of march ( ofcourse from within UK). I have 2 questions.

1. My wife will also be applying with me as a dependent. I have been in the UK for over 2 years. I am assuming that the amount of maintenance funds(for 3 months) shown to be 800+533 = 1333£ . Am i right ? (I could not find the exact information in the UKBA website for this.).

2. I will have enough points from my past 12 months earnings by the time i apply in march. I plan to claim earnings points for 40,500£. But off these, the amount of gross pay each month is not same. Like, I took a break for the first 3 months so i was paid just 1000£ per month. I got a hike 2 months back, and i have my annual bonus paid as part of my salary in one of the months too.( All these earnings are from the same employer.).

Do you guys think, i should explain to the immigration officer all these reasons in the covering letter, or they wouldn't bother as long as the total earnings for 12 months is enough to claim the required points.
Or should i consider applying in person ?

Any inputs will be very helpful.

£800+ £533 for each dependant

As long as you have "earned" all the amount you are claiming you're good to go. You don't need to mention why you got paid extra or less each month as long as you can provide documents that you got paid (payslips+bank statements etc). Salary they consider is gross amount i-e earnings before tax.

Any inputs will be very helpful.
Goodluck.

Thank you very much for the reply Senior Member.
Can you please help me with the following query too ?

I am switching from Tier 2 to Tier 1, My wife will also be applying with me to switch from Tier 2 dependent to Tier 1 dependent. I am assuming that, it is two different applications for each of us and that they are to be posted together. Is that right ? Can you please provide me with the link for the correct application form ? ( Because the one i looked at says the fee is 500£. but the fee for dependent when applying with the main applicant is 250 or 300). Can you also please advise me on the supporting documents i should provide with my wife's application ( apart from the marriage certificate and her masters degree for english language qualification ) ?
