URGENT PlZ, Applying For SET(M) ILR Visa.

Hi All,

I am on a husband (Spouse Visa) and should apply for my ILR set (M) before May 2011.

I am a civi engineer and I have a BSc degree. When I arrived to the UK, I lived with my wife at her parent's house and we had our own room. At that time, my wife was a student (sport science) and had a part time job and we lived on my savings and her income for a year. At that time, I could not find a job and I studied a distance learning highway design course at city of Bath college.

Then wife got pregnant and we had our baby 5 months ago. At that time, we lived on her maternity leave and she applied for housing benefits that pays about 75% of our rent. When she applied for the housing benefit, they told her it should not affect my visa status.

At the moment, I am doing a Masters degree in civil engineering and she is also a student in her final year and we are just living on her maternity leave and my savings.

When applying for the ILR, I am concerned about the following and I need advice please:

1- My wife recieves the following public funds: housing benefit, child tax and credit. Does this ruin my application??

2- I dont have a job, as I am still a student (the course will finish in september 2011).

Once we both finish our degrees, we should have good prospects, she can be a sports teacher or a sports scientist in a lab and I will hopefully find a graduate engineering job, but I am not sure if this would be taken into consideration.

Furthermore, what If my ILR got refused, where I will have a third term at Uni from May to September?

I will be waiting for your advices very anxiously.

Hi All,

I have spent ours loking through the forum hoping to find similar questions and answers to mine but I could not find.

I would appretiate it if any of the moderators or the members could offer advice.

No one can imagine how stressed and bad I feel, imagining tha there is a possibility that I cannot live with my wife and lovely daughter any longer !!

I am sure I'll recieve a reply, just unable to be patient because I am very stressed!

Sorry for posting too many times.

Just for clarification, the benefits she recieves are student benefits, housing benefits, child benefits and child tax (we did not even recieve the child tax yet).

salam brother,
there`s nothing to worry about
as long as you both have letters in your name,can proof that u lived together , it`s absolutely fine , bel 3arbi y3ni kollou tamam w ma fich hata mochkel :wink: all wat u need is to pray to god and it`s guna be fine.
You have savings and your wife is allowed to claim benefit!
in other sense ; let`s say u was not married to ur wife and u still in egypt m, ok . She will still receive all the benefits . you are not affecting the asmount of money she is getting,it`s for her and your child, tax credit , housing benefit and council tax benefit are claimed by your wife , because she have the right to have them as a british citizen. Also you are not claiming jobseeker allowance and income support as these one proof that u cannot support ur family and u need more money from the government.
Your situation is fine and inchallah everything will be fine,it`s normal to worry and stress.
