Hi

I am on Tier 2 and my wife applied for dependent visa from Pakistan on 22nd november got refusal letter on 13 dec from abu dhabi section. The reason was really stupid that I don't have enuf maintenance fund in my account and required is £533. Actually ECO overlooked the bank statements as we attached two bank statements one was current in which my salary and all the transactions were shown other was saving account. Current account was below £500 for just one day during october and he refused based on that. Though we submitted saving account statement which was showing more than required funds available and we did mention that in supporting letter as well. I have lodged the appeal through solicitor in UK to Tribunal. My only worry is how long appeal process gona take probably six months???. Has any body got any experience of decision overturned with abu dhabi branch as I heard so many bad things about these guys. The only quickest way is if we get decision overturned otherwise we need to go for new application with appeal still pending. do somebody know the effect of resubmitting with appeal still pending????

please reply if anyone knows about abu dhabi decision overturned probability.. this will help to think whether to reapply or wait for appeal decision...

Hi Waqas,

I applied for my mother's visit visa and it was rejected by abu dhabi ECO (reason being that I can't support her although my bank statement showed way more than required funds). we lodged an appeal in May and hearing date was in mid December. Although we haven't received the written decision but I have feeling that the ECO decision was overturned by the immigration judge.

IMHO appeal could take well more than 6 months. You can reapply, that will be quick but there is no guarantee that they will not make the same mistake again.

yeah I agree no body can guarantee that they will not make any other silly mistake again but alot of people telling me that it is just delaying tactic or rather they want u to just give them fee one more time. Because dependent visas r normally straight forward.

I know in appeal it can easily anything between 6 to 9 months. In your case if the ruling has been in ur favour u still need to wait for another 12 weeks ( 4 weeks for home office if they want to challenge the decision or not and 8 weeks for ECO to send you the call letter for submission of passport).

My only worry is time. I asked the question because their track record of overturning decision is very poor I blv but if anybody had any luck recently I can wait for atlest Jan to see if they will do or not. Otherwise I think I will go for another application inshaAllah at the end of Jan and hope they will grant visa that time.

does anyone know if we can appeal and reapply at same time.... I am confused as somebody told me that ECO can ask to take appeal back before processing new application... ????

why spend rs:49000+ again to re-apply? that is what ECO wants u to do, .....money...they are there for business bro. those who think like u are good customers ane ECO loves them. And can u guarantee that they will not make another stupidity???
i think u are on right track, be patience but addition to solicitor, write to ur local MP with all attested copies of documents u submitted, and tell that u are writing to him/her because it takes ages to get appeal results and u can't wait and it is disturbing ur personal life. if ur local MP belongs to labor party then it is much better bcoz they are against current immigration settings.. i hope this will give u some sort of outcome prior to appeal.

I agree with you bro appeal is the right decision b.c we are sure inshAllah we will win it... but the question is time.. anyhow can you please explain what can local MP do??? I dnt think if he can influence ECO or immigration decision ... our MP is fortunately from labour party and I have met him personally as well... can you please explain in detail so that I can start this process... what this can do for us???

well, MPs have direct access to most senior members of staff of Homeoffice through fax an phone and their voice is heard. They dont interfere with current law but if there is a stupid objection/mistake on behalf of homeoffice or human right issue etc they can request higher authorities to double check that, so it is like ''doobtay ko tinke ka sahara''. most of the time it works if u have a valid point which makes common sense. Ur case is simple, ur evidence has been overlooked and as a result ur plans have been thrown are 3 to 6 months ahead. so just give it a try, u are not the first one who will do so.
