overstayed in london

Post by vasu » Mon Nov 14, 2005 5:19 am

Hi,
I am an indian national worked in UK from the past 3 years on a UK workpermit, My visa expired on feb 2005 of this year, i have overstayed for 8 long months and came back to my home country india, while coming back to india the home office at the airport has checked my passport and saw that i have overstayed and asked me why i was over stayed , i could not give any reply to them, so they have written on my passport on the visa that i am embarked at LHR Terminal 3 on 12th october 2005 . and the home office officials came to me and said that i cannot come to UK in my life as i have the breached the immigration rules, When i came back to india i lost my passport and have applied for a new one , i have got the new one with the old passport number in it.
my question is
can i apply for a student or any other visa now as i have a new passport ?
what are the chances of getting a visa?
even if i get the visa , will the immigration people allow me to come to britain as i have breached the immigration rules ?.
will they have my record as i have overstayed ?
please give me a early reply as i am desparate to come to Britain,

Vasu,

the local British High Commision will have your details on their database - i think it is called INDECS

so unless your name and date of birth mysteriouily change  it will be difficult to get another Visa

Vasu - could you please explain whether they have re-introduced exit controls?
Where there is a will there is a way.

Chess,

My recent experience of departing from waterloo (Eurostar) and Heathrow terminal 3: immigration officers have questioned me about my immigration status in the UK and checked my passport to see whether I was staying legally in the UK.

I know of one person who had overstayed and who had the words "prohibited immigrant" stamped on his passport. It seems they are clamping down on overstayers...rightly so. In my opinion, they should be kicked out permanently from the UK unless they can prove compelling grounds for overstaying.

Vasu,

I just came accross this other post of yours:

Hi,
one of my freind has applied for my H1B visa from london in the month of feb2004 , the visa officer has refused his visa under section 221g and said that his case was under adminstrative processing, after 15 long months he was so frustrated that he did not get any reply from the embassy, and he has withdrawn his case from london us embassy,
right now he is in india and he his applying again from Indian embassy with a newemplyer , he has lost his passport as well, he is applying with a new passport with his old passport number in it.
His questions are :
will the US embassy in london share the information with the US embassy in India as he has applied from london.
or can he always tell the us embassy in india that he never applied for H1B from london , and this is a first time application made my him.
please reply
What a coincidence that both you and your friend have lost your passports after running into problems with immigration.

Hi there,

How did it go with the entry clearance? I understand that lots of people were questioned at the airport. Did the immigration officers question you or just let you off? Did they escort you to the plane?
