Dependent visa rejected on the basis of not subsisting marri

Post by zjz0923 » Sat Jan 08, 2011 9:18 am

Hi every one,

Urgent help needed. Work permit holder's dependent visa rejected and need appeal.

I am a work permit holder and have a job in UK. I applied a dependent visa for my wife in Dec in Beijing.
But the UK embassy refused her visa on the basis of not subsisting marriage.

Here is my story with my wife:

I knew her through a social network website back in Feb 2010, we entered a relationship in May 2010 and got married in Beijing in Dec 2010,
she applied visa straight after the marriage registration (we did not have our wedding yet, as we'd like to hold the wedding in summer rather than cold winter)

Here are the main suspicious points that the visa officer had asked:

1. We did not live together after our relationship, she was living in Portsmouth and I lived in swindon, 90 miles away.
I did visit her every other week during the weekend and she came to my place as well. She had a job under her PSW visa which was supposed to expire in Oct 2010.

2. I proposed in Oct 2010, while her visa expired at the end of Oct 2010, here is the main point of not subsisting.

3. She went back to Beijing before her visa expired, and I went back one month later and got registered as husband and wife,
she applied the visa straight away without having wedding.

As proof of relationship I submitted the following documents:

Letter of statement from me and my wife saying the story between us;

Photos of us together about 6 to 8 photos including the receipt of the engagement ring I bought for her and photo with both of our parents before marriage registration.

Train tickets for visiting her, I have lost most of my train tickets, I submitted online booking about one ticket in a month. (I cannot find the missing ticket).

Emails and MSN, Skype online chats records.

Mobile phone bills showing that we did communicate with each other every day.

SMS text messages from my mobile phone, lots of them about 5 to 10 text messages per day!

My boarding pass showing I did went back in Dec and got married with her.

I cannot think of any other evidence showing our relationship is genuine. I can verify my marriage certificate in the local government.

Could anyone give me some tips about the appeal? Is there anything else I can do apart from
going back to Beijing again soon and get the wedding and shoot some photos and log another application?

Thanks very much in advance!

Yong
