Tier 2 to Tier 1- how should I ?

Hello All ,
I am new to this board so apologies if I make any mistakes in posting.
I would like to know the fastest and best way to convert my husband's Tier 2 visa to a Tier 1 HSMP.
I have been trying to get an appointment online for premium service but there have been no appointments available in any of the centres for the past 10 days. They always show full .
I called up but the office says they cannot help online.
Is it better to post?
what are the risks either way ?
Do you guys use lawyers?
how do you make sure your documents are all in order?

Also , Can we apply for Tier 1 from Tier 2 from the USA? Is it a faster turn aorund time there. We have indian passports? or does it have to be applied for only for UK?
