We only award points for hours of up to 48 hours per week, even if you work longer. For example, if your annual earnings are £25,000 for 60 hours of work per week, the same earnings for 48 hours of work per week would be £20,000. So you would be able to claim 10 points for your earnings.

also if a salary requirement of a job ABCXYZ in code of practice is 15 pounds per hour. will i satisfy the requirement?

My question being... what is an average num of hours in a week according to the code of practice and should i bother if i am working less than 48 hours. i.e whatever i am getting paid is my ACTUAL income and will not be pro-rated for 37.5 hrs in a week?.

IMO it would be as follows:

15 points, no pro rating as you are working less than 48 hrs. The pro rating only serves to reduce your salary if working over that amount of hours.

Doing some rough calculations I can't see how you would satisty this requirement on your current salary.

ie: 40 hrs a week x 52 weeks = 2080 hrs per year
25000/2080 = £12.02 per hr

that is assuming a 40 hr week, you are working more so your per hour rate is effectively lower.

Regardless of whether you meet the points through your prospective earning bands, if your employer doesn't have a COS allocation and need to apply for one, you are back to square 1.

i.e. you get into the vicious circle of limits even if you are an in-country applicant. As at last panel (January), non-shortage job cut-off band was 36k and shortage job 28k.

ashleyransoo, could you please disclose your source of info about 28k limit for shortage? and i will really appreciate, if you can find an email or something from ukba



wf i looked at all obvious places but couldn't back up your claim that "any salary will not be pro-rated if its less than 48 hrs". obviously im missing something. could you please point me in the right direction. i want to see it with my own eyes, and im sure many readers of this forum will also appreciate you taking time to find that reference.


ashleyransoo, im doing this research to convince my employer for a raise, so that they get a COS in first attempt and an email from ukba about limits etc for last few months, november, dec, and jan would really help my case. so please take a moment to find that email(s) and i will really appreciate it.

That is based on the information you quoted in your first post.

Worded slightly differently but with the same meaning:

80. Where the applicant is paid hourly, points will only be awarded for earnings up to a maximum of 48 hours a week, even if the applicant works for longer than this. For example, an applicant who works 60 hours a week for £8 per hour will be awarded points for prospective earnings of £19968 (8x48x52), which equates to 5 points, and not £25960 (8x60x52) which would equate 20 points.

71. If you are working more than 48 hours a week, you should work out your equivalent earnings for a 48 hour week as set out above before adding any allowances.
Note no similar paragraph or any other indication you can prorate your salary upwards if you work less then 48 hrs.
