Advise needed plz

Hey everyone
I am not EEA married to EEA member ...
We married in dec 2006 , I got my 5 resident in aug 2007 , it will exp in aug 2012, can I apply for my PR in dec 2011.

yes you can as long as you can provide evidence of her exercising her treaty rights from the time of marriage till December 2011 and that you have been living together .

thx for the replay ngueda2009
my wife passport will run out in july 2012 do think if i submit my application in dec 2011 or a month before that , HO would be asking for new passport or anything like that .
