Widowed mother setting in UK

Post by pongirl » Sun Jan 23, 2011 11:55 am

I have recently been granted British Citizenship. I am looking to bring my mother from India to live with me. I notice that the information on HO website is quite vague. I would be grateful if someone can help me with some information:

My mother is 62 years old and has been travelling back and forth from India to UK for the last 4 years. My father recently died (though they separaetd in 1986). My only other sibling lives in US and financially dependent on her husband. My mother is living alone in India. My uncles and aunts (my mother's siblings) have never been supportive of my mother and have always maintained their distance as my mother married my father who was a different religion to them against the family's wish which they are still bitter about.

My mother is not financially dependent upon me with 4-5 streams on income and about £200,000 worth of properties and investment in India if she liqudated them all. (all of which she has already decared to UK embassy when she got her visitor's visa)

Will this case be considered under compassionate circumstance on the following basis:

1. That both her children are out of India and she lives alone in India
2. That i am a single parent who is brining up a small child on my own with no family support (i earn a decent salary and work full time) and i am struggling on my own.
3. Travlling so much and the unstable situation has caused a lot of stress for my mother and her health if going down
4. That she is financially well off that she will at no point need to access public finances.

I would be grateful if someone can help me in this matter.

Thanks!

Point 4 will not be a plus but a big negative in securing her move here. The eligibility clearly states
1. Widowed parent
2. Has no one else closer to financially support the person
3. Has no income stream and funds to manage on their own.

So while all you stated will definitely help her with the application, her own assets worth £200k will be a major issue. One possible way to overcome, though I am no authority nor can advice professionally, is to 'somehow' remove these assets from her name to clearly show she depends ONLY on you for financial support. As she has previously declared this to the embassy, it may difficult.
Your best option may be to consult with a well known lawyer and figure out the best possible route. Being a widowed parent, chances are good provided you meet the eligibility criteria which they will not waiver from in any case

EDIT - To show she wont claim any benefits, it is YOU who has to show you have ample funds to support your young family and your mother if she were to be given permission to settle here. So your mom's finances has nothing to do with being able to support herself whilst here, its based on YOUR income only

Wish you the best
