Getting spousal visa while being on benefits

Post by rajauk » Thu Jan 27, 2011 1:12 pm

Dear all,

I will be grateful if someone could help me here. We intend to hire a lawyer but I thought I'll try to get some advice here as some of the posters here are more knowledgable then some lawyers, I suspect.

The question is regarding my cousin who is getting married abroad. She is British national. She currentily lives with her parents who live in a council house and get benefits. She also gets benefits including disability so she is unable to work. With her situation how can she get a visa for her husband to be?

He intends to start work as soon as he comes here but how will he get the visa? How will we be able to satisfy the ECO that he will not be burden on public funds. One thing my other cousin who is very well off is willing to sponsor him financially until my cousin husband gets on his own feat. we also may be able get a job offer for him.

Please advise as to what we should do? Also what type of documents will she need to give to British embassy in order to get visa for her husband after they are married.

She can try 3rd party financial support from a close relative to show that her future husband can be supported without her resorting to claiming addistional public funds to support him.

She can carry on claiming benefits in her own right as she is legally entitled to do as a British citizen.

3rd party support is now allowed whereas it was not before.

The question is will she be able to accommodate him untill such a time he finds a job and is able to earn eneough to support him and his wife in the long term
