Post by vik_mad » Fri Jan 28, 2011 4:11 pm

Hello All,

I am on Tier1 02nd stamp and it is valid until 31/05/2012 however I am short of 1 month and 3 days for my ILR as i entered the UK late.
Could you please advise if i can apply for the extension of Tier1?

Regards,

Yes.

However, ILR postal application may also be possible.

Vinny, if the date of application (posting) is outside the 28-days window, won't the application be refused for being submitted before becoming eligible for settlement?

John wrote:Also, and quite deliberately, pay by cheque, rather than by credit or debit card. That is ensure that the payment clearance process takes a few days. In this way the papers will remain in Durham (or wherever they are processing the payments then) for a few days before they get passed to a "real office" for processing, and by then you will be well within 28 days of the completion of your 5 year period.

If the "date of application" (i.e. - date of posting) is what matters, I do not see how a delay in payment processing would lead to a positive result - unless the caseworker can apply "discretion" in the matter.

When someone makes an effort to help, he/she expects (at a minimum) that one reads through the given information (in the link and the linked document) carefully .... before jumping to an assumption!

Hi sushdmehta,

Thanks for the link. Based on the this link [
http://www.ukba.homeoffice.gov.uk/sitec ... ier1-2.pdf], the parliment has approved isn't it and it will be effective from April'11?

But the link pointed by you is still showing as 'Draft - subject to parlamentary approval' - [http://www.ukba.homeoffice.gov.uk/sitec ... iew=Binary]

Thanks,

srirags, the "draft" will become "official" only on 06-Apr-11 .. even if parliament approves. So, if you wish to see the "non-draft official document", wait until then.
