Hi everyone,
I need some information regarding right of retain of RC after a divorce.I can understand that its 3 years from marriage and 1 year for co habitation.but is there anyone who can tell me that what we need to write in letter to HO.when i have to present our case to HO.i mean we have to write a covering letter regarding the circumstance if anyone can let me know that what to write in a letter.
my ex was working as a self employed and before i got RC she was working full time but after that she was working part time and we had last 3 years tax returns submitted in the inland revenue which her agent/accountant send her by email that tax return was submitted and we had also a letter from that agent/accountant that he acted on her behalf to submit her tax return.my point is that if i would print that tax return and that agent's letter in order to show that she had submitted that tax returns and she was working as a self employed there would be any problem or not.one thing she was just working part time that would be acceptable or not.we had no recourse to public funds at all neither she nor me.she is still registered as a self employed even the decree of absolute is also issued last month.
do i need to send my passport as well with all the regarding documents?
we had moved from our previous address to a new one and i had some proof of old address and some proof of new address that we were living at the same address.does royal mail re direction letters would help us.

please be a little bit specific when did you get married, when did you divorce
are you working at the moment . did you and your ex had comprehensive health insurance,. part time work is not a problem so do no worry about that. as for the email, remember the ho want the original letter not email. why can't you ask you ex to see her accountant to get the original letter

hi just to let you know that its a letter but he did send through email means its a proper letter on her accountants lettet pad confirming her details n stuff like that.as far as insurance is concerned i havnt heard about it that we need a health insurance as well.my all paper work is going to be ready very soon i was bit concerned about her part time job.thanks for the reply.

sorry to mention that i am working full time i am a self sufficient but why we means me n my wife needs comprehensive health insurance.we are in uk and i am registered with nhs can you please explain that thing.thanks

if your wife was working during the three years of your marriage up to the time of the divorce, in that case you do not need comprehensive health insurance. i repeat it does not matter if she is doing part time or full time she is working. in order to apply you have to produce evidence of your wife working up till the time of the decree absolute, evidence that you were living together, evidence of you working from the time of the divorce up till now. yes you have to send your passport and two pictures , decree absolute. please read my case because i apply for retention of rights.

thanks for that.from where i could see your case if you can send me a link would be helpful.pls could you tell how long HO will take to issue a RC and they would cancelled my previous RC and issue a new one for 5 years on A4 paper is it true.thanks pls send me a link of your case.

yes the ho will issue you a new rc not necessary on the paper unless you request your passport back before they made their decision. how long it will take i don't know it is taking on average 4 months now. my took 4 months

hi now i am going to tell you what i got to send right
1.right of co-cohabitation this i got her bank statement plus mine bank statement at the same address then we got moved to another address and i had re-direction on our post then after that her self employed statements used to come at new address plus i had bt phone line on my name as well at the new address plus i had letters from royal mail for redirection on our names(on me n my wife's name)plus i had letter from her accountant as well who submitted her tax return every year.
2.in order to show myself self sufficient i have my payslips plus P60's
3.in order to show her treaty rights i have her self employed statements which normally comes after each 3 months(to pay national insurance contribution) plus her tax returns plus confirmation from inland revenue that tax return had successfully submitted plus letters from accountants and a copy of tax return which was submitted inland revenue till now.

4.decree of absolute
5.proof of initation of divorce
6.passport plus 2 pictures(mine)
7.letter explaining the circumstances
and you mean they would issue a new RC on the passport instead on A4 paper if you don't need your passport in hurry?am i right
and they cancelled(i mean crossed)the previous RC while issuing a new one.
so that's all i think and one more thing i would like to ask you that did they send any confirmation regarding your application or we just have to wait for the decision to comei mean for a new RC.
